Terms of Media Use — Real Estate Sale Listing

“Client” means the individual, agent, brokerage, company, or entity placing this order or named on the order, invoice, or checkout form.

“Media” means all photography, still images, video, audiovisual content, social media content, reels, virtual tours, floor plans, animations, drawings, renderings, edited versions, derivative works, AI-enhanced versions, AI-generated derivatives based on visuals produced by Anthony Ghiglia Photography / Spazio Photo, and any other visual or audiovisual deliverables created by Anthony Ghiglia Photography / Spazio Photo for the specific property identified in this order.

Upon full payment, Client is granted a limited, non-exclusive, non-transferable license to use the Media solely to market the specific property identified in this order while it is actively listed by Client for sale.

Permitted use includes the property’s MLS listing, real estate listing platforms, property-specific print and web marketing, property-specific social media posts, property-specific email marketing, and the Client’s website, provided each use directly pertains to the active sale listing of the specific property identified in this order. Client may upload still images and other Media accepted by the platform to the MLS and related real estate listing platforms solely for that purpose, but may not claim, assign, transfer, or grant any ownership rights in the Media to any MLS, brokerage, platform, or third party.

This license does not include general brand, company, recruiting, portfolio, advertising, or promotional use on the Client’s website, marketing materials, or any other channel unless directly tied to the active sale listing of the specific property identified in this order. Additional licensing is available for broader brand, company, advertising, portfolio, or promotional use.

The Media may not be sold, shared, transferred, sublicensed, materially altered, edited, filtered, AI-modified, used to create derivative works, or provided to vendors, agents, brokers, property managers, homeowners, design companies, architects, builders, publications, platforms, or any other third party for separate commercial or editorial use without written permission from Anthony Ghiglia Photography / Spazio Photo, except for standard cropping, resizing, or formatting required for the active sale listing.

Once the property is no longer actively listed by Client for sale, Client is responsible for removing the Media from any MLS, listing platform, website, marketing channel, social media profile, or other location where Client controls or has the ability to remove it.

Client represents that Client has authority to order creation of the Media and that any necessary authorization from the property owner, homeowner, HOA, building management, or authorized representative has been obtained for Anthony Ghiglia Photography / Spazio Photo to create, use, display, market, and license the Media as stated in these terms. Client agrees to be responsible for any claims arising from Client’s lack of authority to grant these permissions.

This license does not transfer copyright ownership. All Media remains the property of Anthony Ghiglia / Anthony Ghiglia Photography. Anthony Ghiglia Photography, operating as Spazio Photo for property photography services, retains the right to use, display, advertise, publish, market, and commercially license the Media for portfolio, marketing, advertising, editorial, and other lawful business purposes. Any future use by another party requires a separate license from Anthony Ghiglia Photography / Spazio Photo.

These terms are governed by the laws of the State of California. Any dispute, claim, or legal proceeding related to these terms, the Media, licensing, or services provided shall be brought in the state or federal courts located in San Diego County, California.

Submitting this order, completing checkout, or paying the related invoice constitutes acceptance of these terms by the Client.
