Terms of Media Use — Short-Term Rental / Long-Term Rental

“Client” means the individual, company, or entity placing this order or named on the order, invoice, or checkout form.

“Authorized User” means Client and, only if identified in the order, invoice, checkout form, or approved in writing by Anthony Ghiglia Photography / Spazio Photo, the specific property manager or management company authorized to use the Media for the property identified in this order.

“Media” means all photography, still images, video, audiovisual content, social media content, reels, virtual tours, floor plans, animations, drawings, renderings, edited versions, derivative works, AI-enhanced versions, AI-generated derivatives based on visuals produced by Anthony Ghiglia Photography / Spazio Photo, and any other visual or audiovisual deliverables created by Anthony Ghiglia Photography / Spazio Photo for the specific property identified in this order.

Upon full payment, Client is granted a limited, non-exclusive, non-transferable license for Client and any Authorized User to use the Media solely to market the specific short-term rental property or long-term rental property identified in this order.

If Client is a property owner or homeowner and intends for a property manager or management company to use the Media, that manager or company must be identified in the order, invoice, checkout form, or approved in writing by Anthony Ghiglia Photography / Spazio Photo before using the Media. Client is responsible for ensuring that any Authorized User receives and complies with these terms.

Permitted use is limited to marketing the specific property identified in this order for rental or lease purposes. This includes use on Airbnb, VRBO, Booking.com, Expedia, direct-booking websites, rental listing platforms, social media posts, email marketing, the Client’s or Authorized User’s website, and other rental, hospitality, or listing channels, provided each use directly pertains to the active rental listing, lease listing, or property-specific webpage for that specific property.

This license is personal to Client and any Authorized User and is not a transferable business asset. It may not be sold, assigned, transferred, sublicensed, or included with any sale or transfer of Client’s business, management rights, property portfolio, or individual property. Authorization for one management company does not extend to any future or replacement management company. Any new or successor owner, manager, company, or third party must obtain a separate license from Anthony Ghiglia Photography / Spazio Photo to continue using the Media.

This license does not include general brand, company, recruiting, portfolio, advertising, or promotional use on the Client’s or Authorized User’s website, marketing materials, or any other channel unless directly tied to marketing the specific property identified in this order. Additional licensing is available for broader brand, company, advertising, portfolio, or promotional use.

The Media may not be sold, shared, transferred, sublicensed, materially altered, edited, filtered, AI-modified, or used to create derivative works without written permission from Anthony Ghiglia Photography / Spazio Photo, except for standard cropping, resizing, formatting, or platform display required for the approved property-specific listing use.

The Media may not be provided to other property managers, agents, brokers, homeowners, vendors, design companies, architects, builders, publications, or any other third party for separate commercial or editorial use without written permission from Anthony Ghiglia Photography / Spazio Photo.

If Client or Authorized User no longer owns, manages, represents, or markets the property, Client is responsible for removing the Media from any rental listing platform, website, marketing channel, social media profile, or other location where Client or Authorized User controls or has the ability to remove it.

Client and Authorized User may not claim, assign, transfer, or grant any ownership rights in the Media to any platform, property owner, management company, brokerage, vendor, or third party.

Client represents that Client has authority to order creation of the Media and that any necessary authorization from the property owner, homeowner, HOA, building management, or authorized representative has been obtained for Anthony Ghiglia Photography / Spazio Photo to create, use, display, market, and license the Media as stated in these terms. Client agrees to be responsible for any claims arising from Client’s or Authorized User’s lack of authority to grant or comply with these permissions.

This license does not transfer copyright ownership. All Media remains the property of Anthony Ghiglia / Anthony Ghiglia Photography. Anthony Ghiglia Photography, operating as Spazio Photo for property photography services, retains the right to use, display, advertise, publish, market, and commercially license the Media for portfolio, marketing, advertising, editorial, and other lawful business purposes. Any future use by another party requires a separate license from Anthony Ghiglia Photography / Spazio Photo.

These terms are governed by the laws of the State of California. Any dispute, claim, or legal proceeding related to these terms, the Media, licensing, or services provided shall be brought in the state or federal courts located in San Diego County, California.

Submitting this order, completing checkout, or paying the related invoice constitutes acceptance of these terms by the Client.
